Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and RentMatcher ("RentMatcher", "we", "us", or "our"), operated by Chase Sims d/b/a RentMatcher. They govern your access to and use of the RentMatcher mobile application, website, and related services (together, the "Service").

RentMatcher is a neutral technology platform that helps renters discover landlords' rental listings and helps people find potential roommates through swipe-based discovery, in-app messaging, and tour requests. RentMatcher is not a broker, agent, landlord, property manager, tenant-screening company, background-check provider, credit-reporting agency, or party to any rental or roommate arrangement.

1. Acceptance

By creating an account, accessing, or using the Service, you agree to these Terms, our Privacy Policy, Community Guidelines, Fair Housing Policy, and any product-specific terms shown to you in the app. If you use the Service for a company or other organization, you represent that you have authority to bind that organization.

2. Eligibility And Account Security

You must be at least 18 years old to use RentMatcher. You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at support@rentmatcher.com if you believe your account has been compromised.

Roommate matching requires full verification: a verified phone number, a verified email address, and a second factor such as an authenticator app (TOTP) or passkey where supported. Verification is an anti-abuse measure only. It is not a background check, endorsement, or guarantee of any user's identity, character, safety, background, or conduct.

3. Listings, Matches, Messages, And Tours

Users are solely responsible for their listings, profiles, messages, photos, availability, tour requests, roommate preferences, and any rental or roommate arrangement they pursue. RentMatcher may rank or score listings and profiles based on information users provide and product activity, but scores are estimates only and never guarantees.

RentMatcher does not verify that listings are available, accurate, lawful, or safe. We do not collect rent, deposits, application fees, or security deposits. Be cautious when meeting people, touring homes, or exchanging money or sensitive documents, and independently verify any listing or person before entering an arrangement.

4. Fair Housing And Anti-Discrimination

RentMatcher complies with the U.S. Fair Housing Act, and users must comply with all fair housing, civil rights, source-of-income, consumer-protection, and anti-discrimination laws that apply to them. You may not make, print, publish, or state any preference, limitation, or discrimination based on race, color, religion, sex, national origin, familial status, disability, or any other class protected by federal, state, or local law.

This applies to listings, bios, messages, lead notes, tour communications, roommate preferences, and any other content or conduct on the Service. We may screen content, remove content, limit features, suspend accounts, and report or preserve information where needed to investigate fair-housing, fraud, safety, or legal concerns.

You retain ownership of content you submit. You grant RentMatcher a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, distribute, and otherwise use your content solely as needed to operate, provide, secure, support, and improve the Service, including showing it to other users as the product is designed to do.

You represent that you have all rights necessary to submit your content and that your content does not violate law, these Terms, our policies, or any third party's rights.

7. Landlord Premium, Subscriptions, And Boosts

Renters pay nothing to browse, match, message, use roommate matching, or request tours. Landlords may purchase paid features through Apple In-App Purchase, including subscriptions and consumable Boost purchases that increase listing visibility for a defined period.

Apple handles billing, renewal, cancellation, and refunds for App Store purchases. Unless required by law or Apple policy, payments are non-refundable once delivered. Subscriptions renew automatically unless canceled through your Apple account settings at least 24 hours before the end of the current period.

8. Third-Party Services

The Service may rely on Apple, Google/Firebase, Meta/Facebook, Vercel, and optional landlord listing, calendar, booking, property-management, or market-data integrations. Third-party services are governed by their own terms and privacy practices. RentMatcher is not responsible for third-party services or for user dealings with them.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, RentMatcher disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, accurate, complete, error-free, or available at any particular time, or that any listing, profile, match, score, message, tour, integration, or report will meet your expectations.

10. Limitation Of Liability

To the fullest extent permitted by law, RentMatcher and its affiliates, service providers, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to the Service.

To the fullest extent permitted by law, RentMatcher's total liability for all claims relating to the Service is limited to the greater of the amount you paid RentMatcher for the Service in the 12 months before the event giving rise to the claim or US$100.

11. Indemnification

You agree to defend, indemnify, and hold harmless RentMatcher and its affiliates, service providers, officers, employees, contractors, and agents from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your use of the Service, your interactions or arrangements with other users, your violation of these Terms or our policies, or your violation of law or a third party's rights.

12. Dispute Resolution

Before starting a formal proceeding, you agree to contact us at support@rentmatcher.com and give us 30 days to try to resolve the dispute informally.

If a dispute cannot be resolved informally, you and RentMatcher agree that disputes arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by JAMS under its applicable rules, except that either party may bring an individual claim in small-claims court if it qualifies.

You and RentMatcher agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, private-attorney-general, or representative proceeding. You may opt out of arbitration and the class-action waiver by emailing support@rentmatcher.com within 30 days after first accepting these Terms.

13. Governing Law

These Terms and any dispute are governed by the laws of California, United States, without regard to conflict-of-laws rules, except where federal law or non-waivable consumer rights require otherwise. To the extent a dispute is not subject to arbitration, the parties submit to the state and federal courts located in California.

14. Termination

You may stop using the Service at any time and may delete your account in the app. We may suspend or terminate access, remove content, or limit features if we believe you violated these Terms or our policies, created risk, or used the Service unlawfully. Sections that by their nature should survive termination will survive.

15. Changes

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as through the app or website. Your continued use of the Service after changes take effect means you accept the updated Terms.
